When you draft your Last Will and Testament with Momentum Trust, you can draft a Living Will at no extra cost. This ensures your healthcare wishes are followed if you ever become incapacitated. A Living Will honours your medical choices and spares loved ones from tough decisions.

Will drafting FAQs

The cost of drafting a Will in South Africa depends on various factors, primarily the complexity or simplicity of the document and the end goal you wish to achieve.

Our aim at Momentum Trust is to provide you with an executable Will that meets your unique needs. You have the option to draft a Will online, or through the services of a Momentum affiliated financial adviser. In both instances, provided Momentum Trust is the nominated executor, there will be no charge for drafting the Will. Alternatively, if Momentum Trust is not the nominated executor or if an application form is submitted to our office for drafting, a fee will be payable for this service.

Your Will remains valid until it is replaced by the latest updated Will. The date that the Will was signed will be used to determine which Will is the latest.

It’s necessary to update your Will when your life circumstances change. These life events include:

  1. Starting your working career.
  2. A change in marital status - getting married or divorced.
  3. A change in your assets, such as purchasing a home.
  4. The addition of new family members, including the birth or adoption of a child.
  5. Dependency of family members, especially those with special needs.
  6. Death of a family member or beneficiary.
  7. The establishment of a business.

You can send any updates or changes to your Will to your financial adviser or email [email protected]. It's important not to use codicils which are additional pieces of paper containing new clauses to your Will, or making any written changes on your Will document as this could potentially lead to the validity of the Will being questioned.
